Here is a summary of the new Tennessee Immigration Bill (effective January 1, 2011) TCA 40-7-1123
- Sheriffs must check the immigration status of everyone arrested
- If sheriffs are unable to determine that someone is in full compliance with immigration law they are required to forward booking information to Immigration and Customs Enforcement (ICE)
- Officers are not allowed to enforce civil immigration law and may not arrest you simply because they suspect an immigration violation
- They may only hold you for suspected immigration violations after ICE has issued an immigration hold
