(Kinda) New Tennessee Immigration Bill

31 Mar

Here is a summary of the new Tennessee Immigration Bill (effective January 1, 2011) TCA 40-7-1123

  • Sheriffs must check the immigration status of everyone arrested
  • If sheriffs are unable to determine that someone is in full compliance with immigration law they are required to forward booking information to Immigration and Customs Enforcement (ICE)
  • Officers are not allowed to enforce civil immigration law and may not arrest you simply because they suspect an immigration violation
  • They may only hold you for suspected immigration violations after ICE has issued an immigration hold

This is general information and not legal advice. If you are arrested you should seek the advice of a competent criminal defense attorney. If you are an immigrant you should additionally seek the advice of a competent immigration attorney before any plea agreement or trial. The use of this site does not create an attorney-client relationship.
